Employees required to abide by Hatch Act

With the election season now in full swing, it’s important that DLA employees be aware of rules that apply to them under the provisions of the Hatch Act, 5 U.S.C. Section 7323, which limits political activities of all federal employees. The rules vary based on duty status and position but apply to all activities directed toward the success or failure of any political party or candidate.

 

On March 5, 2018, the U.S. Office of Special Counsel noted that President Trump officially announced his candidacy for reelection. Political activity surrounding the Trump campaign is therefore prohibited and includes displaying unofficial photos of the President in the workplace, as well as placing campaign-related posts on social media while on official duty. The same is true for activities associated with any political candidate. For example, the wear, display or distribution of items with the slogan “Make America Great Again” violates rules under the Hatch Act. Similarly, posting “#Resist Trump” on social media while on duty or displaying such a banner in the work place is prohibited.

 

Members of the Armed Forces are not covered by the Hatch Act, but similar restrictions apply. Service members must comply with DoD Directive 1344.10. Per longstanding DoD policy, active duty personnel may not engage in partisan political activities and all military personnel should avoid the impression that their political activities imply or appear to imply DoD sponsorship, approval or endorsement of a political candidate, campaign or cause.
